Lien Waivers By Chad J. Cochran Vann & Sheridan Video Legal Pad Hi my name is Chad Cochran. I’m an attorney at Vann & Sheridan. Welcome to this episode of Video Legal Pad. Today I’m here to talk to you about lien waivers. We’re going to talk today about three types of lien waivers; A partial lien waiver, a conditional lien waiver and then a full and final lien waiver. For those that extend construction materials to projects and deal with mechanic’s liens, understanding the differences between these three types of lien waivers proves to be very important. So first, a partial lien waiver; these are used when you have extended some materials on the job but you also understand that there is more materials to be provided. So you’re getting paid for some of those materials but this is not payment in full. If your contractor or someone above him in the contractual chain is asking for a lien waiver, and you know that there is more work to be done or more money that may be paid on this project, a partial lien waiver is an important thing to look deeply into the terms of. That is the typical the lien waiver is used early on in a project. Moving forward somewhat you will see two types of full and final lien waivers. Full and final lien waivers mean that you are done with the project. If you sign this lien waiver, you have no lien rights on the project left whatsoever.
